Terms and Conditions
ORDERS
All orders processed in partnership with licensee:Fairley's (M Fairley T/A Fairleys), 62-64 Railway Road, Coleraine, N. Ireland, BT52 1PF
OWNERSHIP
1. On receipt of your completed and signed Terms and Conditions form and receipt of full payment, the title for the cask will transfer to the named purchaser.
2. The cask owner commits to a minimum length three years and is not entitled to fully bottle the cask until this stage.
3. No subsequent transfer, trading of title or sale of the cask to a third party is permitted by the purchaser.
4. The purchaser may not sell the cask to a third party; however, they will have the option at the end of the cask programme (five years) to sell the cask back to the distillery at the future market price.
5. The Cask – The price does not include the cost of the actual wooden Cask which shall remain in the property of the Distillery.
6. The purchaser must have the cask bottled and labelled by the distillery, payable by the purchaser. Offsite bottling is not permitted.
7. The cask can be owned by an individual or a company and there may be multiple names associated with the cask, however, only one name is permitted on the cask title and the onus is on that person to communicate with others involved.
8. Storage costs for 5 years are included in the price. Following this period, charges will apply for further maturation.
9. The purchaser must advise Glens of Antrim Distillery Ltd of any changes to their contact details given at the time of purchase.
10. Casks in the warehouse are insured by Glens of Antrim Distillery Ltd against fire and theft.
11. The casks will be stored in the Glens of Antrim Distillery Ltd warehouse and we reserve the right to move all casks subject to the needs of the business.
12. Access to the warehouse is available by prior appointment only. Please contact: founders@glensofantrimdistillery.com to reserve time.
13. You may request samples of your cask at any stage after your whiskey has been rested for 3 years either during a scheduled warehouse visit or via post (shipping charges will apply).
BOTTLING AND LABELLING
14. When you are thinking about bottling your cask, firstly, make sure you request a sample and then give us a minimum of 3 months’ notice of your intention to bottle. This is required for both partial and full bottling.
15. The purchaser can partially bottle a minimum of 36 bottles and a maximum of 72 bottles up to a maximum of 2 bottlings in total over the lifetime of the cask.
16. You will be required to pay the associated VAT, excise duty and bottling fee in advance of bottling.
17. All “Lir” whiskey will be bottled in the designated Glens of Antrim Distillery Ltd bottles with our “Founders” label and your desired name, cask type, cask strength and cask number on it. No other label is permitted. Partial and later full bottlings will have the same label on all bottles while the year of the whiskey will be written on each label with date of bottling
18. Each cask will be bottled with one label and at one strength regardless of the number of bottlings. You can choose to bottle your whiskey at the desired strength between 40% ABV and Cask Strength; your samples and conversations with our Head Distiller should help you decide.
19. Each cask is subject to the “Angels’ Share”. This is where we see evaporation in the cask of approximately 2% per annum while we also expect to see losses in bottling at around 1%. The above is estimated and may change from cask to cask.
20. Due to Health & Safety Regulations, witnessing of the emptying of the cask and bottling is not permitted.
21. The purchaser must arrange for the bottles to be collected within 7 days of bottling.
22. The purchaser is responsible for the arrangement, collection, and transport of the bottles and for the costs associated with this.
TAXES, EXCISE DUTY & BOTTLING CHARGES
23. The purchaser is solely responsible for any VAT and Excise Duty payable on removal of the whiskey from bond. VAT and duty are payable by the purchaser at the time of bottling. The amount will depend on the number of bottles produced from the cask.
As an indication (based on rates in April 2021):
• Current excise duty in United Kingdom for Single Malt 46.5% ABV strength is £9.35 per 70cl bottle and for Cask Strength at 60% ABV is £12.07 per 70cl bottle. This figure will vary depending on the actual cask strength of your bottles.
• Bottling cost is subject to the costs at the time of bottling, to give an indication the price is currently £3 plus VAT.
• Current VAT is 20% and is payable on the cask purchase price, duty, and bottling costs.
COMMUNICATION
24. Glens of Antrim Distillery Ltd will communicate with the individual noted on the Purchase Form regarding the details of the cask, maturation, bottling and anything else pertinent to the cask.
25. Glens of Antrim Distillery Ltd will communicate with all members of the cask in relation to our regular updates.
26. Your Rights – Under this contract of sale, your rights may not be transferred or assigned to a third party without our consent in writing. This contract of sale is governed by The Law of The United Kingdom and Northern Ireland and we agree to and accept the exclusive jurisdiction of Northern Irish courts in respect of any matters arising from it.
27. To comply with the UK Warehouse Owners and Warehouse Goods Regulations (“WOWGR”) you are required to confirm that you are a private individual purchasing the filled Cask for private consumption or gifting and that the ultimate bottled Irish Whiskey produced from the Cask purchased will not be sold or traded for profit. Your signing of the Order Form will be deemed by us to be your confirmation of WOWGR compliance.
28. By purchasing a cask, you are agreeing that you are of legal age to buy alcohol in your country.
